GENERAL: Prior to the declaration of All clear, consideration was given to a protest lodged by driver Robert Morris on behalf of connections of THE METAL FLYER (Second past the post) against SWEET HAYLEY JANE (First past the post) alleging interference inside the final 50 metres of the event. After considering all evidence provided by driver R Morris (THE METAL FLYER) and driver R Hunt (SWEET HAYLEY JANE) and reviewing the available patrol footage. It was established that, at a point passing the 50 metres THE METAL FLYER had commenced to improve to the inside of SWEET HAYLEY JANE and shortly thereafter near the 30 metres SWEET HAYLEY JANE shifted in, resulting in THE METAL FLYER having to be checked and losing ground at that stage with the official margin between both runners being 1.4 metres at the finish. Stewards found that whilst THE METAL FLYER was checked as a result of a shift from SWEET HAYLEY JANE, Stewards could not be comfortably satisfied that given the proximity to the finish and the manner in which both runners were travelling leading into the incident that THE METAL FLYER would have finished ahead of SWEET HAYLEY JANE and therefore the protest was dismissed and the All clear was given on the Judge’s numbers 4-6-2-1.

SWEET HAYLEY JANE – Withstood protest. Driver R Hunt was issued a reprimand under AHHR 163(1)(a)(iii) for causing interference in that, when passing the 30 metres he permitted his runner to shift in whilst under driving when not clear of THE METAL FLYER which was checked. Post-race swab sample.
