THE FORTUNATE SON – When questioned in relation to her driving A Delosa explained, that she had been instructed to lead and indeed the instructions were issued so explicitly that she was told that should she be challenged for the lead she was to take all measures to resist. She said that after beginning well her drive did not muster sufficient speed to lead in the early stages and because of her explicit instruction, she left a position of cover rounding the turn after the start and drove forward in a three wide position. She added that despite her efforts THE FORTUNATE SON could not clear the leaders, resulting in her being posted three wide for a considerable distance in the middle stages and stated that because of this the gelding weakened inside the 400m. Trainer Mr D Maricic confirmed the instructions and stated that they were issued with regard to THE FORTUNATE SON’s previous record of 13 wins when leading and expressed satisfaction with the way the gelding was driven. After assessing all the circumstances of the race A Delosa was told that whilst her drive did not meet the framework of blameworthiness, she as the driver, despite any instruction must react to circumstances as they unfold and drive in a manner that best suits the conditions of the race to ensure that the best outcome for her drives is achieved. Mr Maricic was told that whilst it is expected that instruction is issued with past performance as a guide, each race must be analysed individually to determine whether such instruction is suitable and should never be issued in a manner that causes his drivers to ignore their own initiative. A post-race veterinary examination failed to reveal any abnormalities.
