KRISTYSGIRL – Driver Jamie Hogan was questioned in regards to the tactics adopted on the filly, in particular the reasons for racing 3 wide without cover throughout. Mr Hogan explained he was instructed to improve to obtain a forward position and as a result he allowed the filly to progress forward after the start and added he felt GINGANING, which was racing outside the leader, was positioned well back from the leader PUDDNDORT which gave him the impression the position outside the leader would be obtainable. Mr Hogan further added passing the 1300 metres he noticed BONDI BEACH NZ was not fully maintaining its position and shortly after directed KRISTYSGIRL in to obtain the position ahead of BONDI BEACH NZ however there was insufficient room to do so and KRISTYSGIRL was consequently unsuccessful in obtaining the desired position. Mr Hogan added as a consequence KRISTYSGIRL was caught racing 3 wide thereafter and in the circumstances was content with the filly’s performance where KRISTYSGIRL was only beaten 14 metres. A post-race veterinary examination revealed no obvious abnormalities. Upon consideration of Mr Hogan’s explanation Stewards were satisfied the tactics adopted were not entirely unacceptable in the circumstances and took the matter no further. In assessing penalty Stewards took into account the HRNSW Penalty Guidelines placing particular weight on Mr Hogan’s guilty plea, his good driving record and the low consequential effect of the incident.
