He said that approaching the 1200m he was unhappy with the tempo and elected to drive forward in an effort to assume the position outside the lead. he stated that after being unable to cross MIDAS SHANNON he was trapped wide and had difficulty restraining his drive and was obliged to race without cover for a considerable distance. On the evidence, it was determined rounding the home turn BETTOR CHEER NZ had established running to the outside of APPLIED NZ which hung out at that point. Then after straightening APPLIED NZ shifted out abruptly under pressure resulting in it locking wheels with BETTOR CHEER NZ with both runners being unbalanced and completing the race in this fashion. Considering the manner that BETTOR CHEER NZ was racing at the time when it was impeded and had its inside wheel locked with the outside wheel of APPLIED NZ it was deemed that had the incident not occurred BETTOR CHEER NZ would have finished ahead of APPLIED NZ therefore the protest was upheld and the placings amended accordingly.
