After considering evidence from all parties and the vision available, Stewards concluded although ULTIMATE TROUBLE did shift up the track BELLAGANOOSH was racing in a position behind ULTIMATE TROUBLE and hadn’t established a run to the outside of that mare, and given the margin 1.25 metres Stewards couldn’t be comfortably satisfied to overturn the result and the protest was dismissed and the all clear was given on the numbers 8 – 2 – 1 – 5.

ART OF RHYTHM – Driver Jett Turnbull was questioned in regards to his driving tactics and the overall performance of the gelding. After beginning well, Mr Turnbull elected to challenge for the lead for a short distance before being obliged to race in the position outside the leader before tiring from the 600 metres to be beaten 78 metres. Mr Turnbull explained the gelding was able to lead at its most recent start and was able to win and felt it was ART OF RHYTHM’S best performance and as such felt the lead may have been available so he elected to challenge for the lead for approximately 100 metres before being caught in a position outside the leader.Mr Turnbull felt the longer trip of 2040 metres and being caught in a position outside the leader was detrimental to the performance of the gelding. The comments of Mr Turnbull were noted. A post-race veterinary examination revealed no obvious abnormalities. ART OF RHYTHM will be required to perform one requalifying trial.

THEYCALLMEBRUCE – Hung out during the score up and shortly after the start for which a warning was issued. Approaching the 600 metres was checked and raced roughly when the pace in the event eased. Approaching the 150 metres was severely checked and broke  when locking wheels with CATHS IN DENIAL.

WHISPERING KEV - The all clear was delayed by Stewards in order to afford them an opportunity to review the start. After the films were viewed and submissions were submitted by Driver Jason Turnbull on behalf of the connections of WHISPERING KEV, it was established that after PIPPA CHEER broke gait and vacated barrier 3, WHISPERING KEV scored up on the second line however approaching the start did improve in advance of its correct barrier position in between TALLARINGA FEELGOOD and EXCUSE TO CULLECT. It was concluded this provided an unfair advantage to WHISPERING KEV and enabled the gelding to proceed forward between TALLARINGA FEELGOOD and EXCUSE TO CULLECT and ultimately find the lead. Acting under Rule 66(h) WHISPERING KEV was disqualified from the event. Stewards gave the all clear on the numbers 7 – 2 – 10 – 8. At a subsequent inquiry, Driver Jason Turnbull plead guilty to a charge under Rule 162(1)(n) in that approaching the start he has permitted WHISPERING KEV to improve its position in a manner which allowed WHISPERING KEV an unfair advantage by starting in advance of its allocated barrier position. In assessing penalty, Stewards took into account the overall driving record of Mr Turnbull, the effect his drive had on the totality of the race and the seriousness of the charge, Jason Turnbull had his licence to drive in races suspended for a total of 21 days to commence midnight 9 February 2025. Post-race swab sample.
