Upon review of the films, Driver Melissa Hawke lodged an objection against first placing OPEN THE GATES alleging interference over the concluding stages in that OPEN THE GATES had shifted into the sprint lane upon entry to the home straight preventing KALYPSO RAINBOW to progress forward to the inside of that runner. After taking evidence from Melissa Hawke Driver of KALYPSO RAINBOW and Ashleigh Delosa Driver of OPEN THE GATES, Stewards were of the view that a point approaching the straight on the final occasion OPEN THE GATES had shifted into the sprint lane preventing KALYPSO RAINBOW to progress to the inside of that runner for approximately 70 metres and when able to gain clear running KALYPSO RAINBOW progressed quickly to be beaten by the official margin of a nose. Given the margin, Stewards were satisfied that had OPEN THE GATES not shifted into the sprint lane and prevented KALYPSO RAINBOW from improving at that point they were comfortably satisfied KALYPSO RAINBOW would have finished in front of OPEN THE GATES and as a result upheld the protest and gave the all clear on the new numbers of 4 – 1 – 7 – 8.
