Mr O’Neill advised he did give consideration to surrendering the position outside the leader during the early stages of the event however once improving into the front straight passing the 1200m he elected to maintain the position when CATCH THE SHARK was improving forward and did not feel it was a suitable runner to follow as the gelding was under significant urging by its driver and never improved close enough to his runner to progress pass. Mr O’Neill added CATCH THE SHARK never improved to his outside until approaching the 800m at which point he felt was too late in the event to surrender in particularly as ADIEU MIKENNIS was always travelling well within itself until being placed under pressure from the 500m and providing to be disappointing. In determining penalty Stewards were mindful of the relevant considerations as outlined within the ‘HRNSW Penalty Guidelines’, the degree of culpability, which was assessed in the mid-range, Mr Blythe’s clear prior record under this rule which expanded over 37 years of driving & nearing on 600 career drives.
